1. Acceptance of these terms

1.1 By registering as a user of Tote Car, or by using any part of the Tote Car website, mobile app or services (the "Service"), you accept these terms and conditions. If you don't accept them, don't use the Service.

1.2 Tote Car may change these terms from time to time. Changes take effect as soon as they're posted on this page. You're responsible for reviewing the current version. Continued use of the Service after changes are posted means you accept the updated terms.

2. The Service

2.1 Tote Car is an online marketplace that connects rental operators who need to move vehicles between locations ("Rental Operators") with drivers willing to relocate those vehicles ("Drivers").

2.2 Tote Car operates as an information and matching service. We do not own, hire, insure or provide vehicles, and we do not employ or dispatch drivers.

2.3 Every relocation is a direct contract between the Rental Operator and the Driver. Tote Car is not a party to that contract and does not act as an agent of either side.

3. Accuracy and risk

3.1 Tote Car makes no representation or warranty about information posted by Rental Operators or Drivers, including the accuracy of vehicle details, availability of the vehicle, or the truthfulness of any user's details.

3.2 The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Tote Car disclaims all warranties, express or implied, including warranties of accuracy, merchantability or fitness for a particular purpose.

3.3 Tote Car isn't responsible for loss, damage, injury, fines or costs arising out of any relocation. Disputes about vehicles, damage, fuel, tolls, fines, insurance or refunds must be resolved directly between the Rental Operator and the Driver.

4. Driver terms

4.1 Registration. To book a relocation you must create a driver account with true, current and complete information. You must be 18 or older and legally able to enter into a binding contract. Rental Operators may impose higher minimum ages for specific vehicles.

4.2 Booking a vehicle. Submitting a booking request is not a guarantee. A relocation is confirmed only when the Rental Operator accepts your request. On acceptance you commit to collect, drive and return the vehicle as listed, at the pickup and drop-off times you selected.

4.3 Vehicle pickup. You must arrive at the depot at the agreed date and time with your driver's licence, matching photo ID and a credit card in your name for the Rental Operator's security bond. You'll sign the Rental Operator's rental agreement before receiving the keys.

4.4 Additional charges. Unless the listing states otherwise, Drivers pay for fuel, tolls, ferries, road user charges, cleaning, insurance excess and any other costs disclosed by the Rental Operator. A small compulsory daily insurance fee (up to $5/day) may apply where required by the Rental Operator's insurance policy.

4.5 Third parties. You may not book a vehicle on behalf of another person. The named driver is the person who must present at the depot.

5. Cancellations, no-shows and misuse

5.1 Cancelling a confirmed booking. Cancel through your account. A cancellation fee may apply based on how close to pickup the cancellation happens, as disclosed at the time of booking. Cancellation fees are separate from any charges applied by the Rental Operator.

5.2 No-show. Failing to collect the vehicle without notifying the Rental Operator is a serious breach of these terms. You authorise Tote Car to charge a no-show fee to the payment method on file (currently up to US$100 or the local equivalent) once the Rental Operator confirms the no-show.

5.3 Disputes. Any dispute about a Tote Car fee must be raised in writing to hello@totecar.com within 7 working days of the charge. Later disputes may not be actionable.

5.4 Termination. Tote Car may suspend or terminate accounts for repeated cancellations, no-shows, misuse of the Service, or misconduct reported by a Rental Operator.

6. Rental Operator terms

6.1 Rental Operators must provide accurate, current information about each vehicle, its condition, its insurance and any driver requirements. Compulsory costs must be disclosed on the listing.

6.2 Rental Operators are responsible for the physical vehicle, roadworthiness, registration, insurance cover, keys handover, and any refunds or bond releases owed to the Driver.

6.3 Rental Operators pay Tote Car a per-transfer platform fee as disclosed in the operator pricing page. Fees are payable regardless of outcome once a booking is confirmed.

6.4 Rental Operators must not withdraw a confirmed booking without reasonable cause. Repeated late withdrawals may lead to account suspension.

7. Content, accounts and use of the Service

7.1 You must not use the Service for anything unlawful, misleading or abusive, and you must not attempt to interfere with, scrape or reverse-engineer the platform.

7.2 You are responsible for keeping your account credentials confidential. Anything done through your account is deemed done by you.

7.3 By posting content on Tote Car (listings, reviews, messages), you grant Tote Car a non-exclusive, worldwide, royalty-free licence to display and use that content in connection with operating the Service.

8. Limitation of liability

8.1 Tote Car does not perform background checks on Rental Operators or Drivers. Each party is responsible for assessing the suitability of the other and the vehicle before proceeding.

8.2 To the fullest extent permitted by law, Tote Car's total aggregate liability arising out of or in connection with these terms is limited to US$100. Tote Car is not liable for indirect, incidental, consequential or special damages, including loss of profits, data or goodwill, even if advised of the possibility.

8.3 Nothing in these terms limits any rights that cannot be excluded by applicable consumer law.

9. Privacy

9.1 Tote Car handles personal information in accordance with our Privacy Policy. By using the Service you consent to the collection, use and sharing of information as described there, including sharing your contact details with a Rental Operator once a booking is confirmed.

10. Governing law

10.1 These terms are governed by the laws applicable to the country in which Tote Car is registered. Any dispute that can't be resolved informally may be brought in the courts of that jurisdiction. Users have any additional rights granted by the consumer laws of their country of residence.
